Is Your Project in Crisis?

Development and construction projects rarely fail suddenly. Warning signs emerge weeks or months before formal acknowledgment. An estimated 35-50% of projects face significant distress whilst up to 90% experience some form of difficulty. This manifests itself in over 2,636 construction company insolvencies between April 2024 and March 2025, and 3,000-5,000 distressed projects annually in Sydney and NSW alone. Early intervention has become critical to project survival.

An Industry-Wide Crisis

Australia's construction industry is experiencing an unprecedented crisis. Between April 2024 and March 2025, over 2,636 construction companies became insolvent - a 23% year-on-year increase representing the highest concentration ever recorded. Thousands of projects have been left distressed, delayed, or abandoned.

The Hidden Scale

Insolvencies are only the visible failures. For every company that fails, 3-5 additional projects experience critical distress through severe schedule delays, cost overruns, contractor disputes, cash flow crises, and technical failures—long before insolvency occurs.

This creates an estimated 8,000-12,000 distressed projects annually across Australia, with 3,000-5,000 in Sydney and NSW alone including projects across all scales: from commercial and infrastructure developments to medium-density apartments, townhouses, and residential subdivisions.

Revolutionary Changes in NSW Property Development

Dual Occupancy Revolution

New minimum lot size of just 450m² and 12m width now permits dual occupancy across R1, R2, R3 & R4 zones.

Override Powers

State rules now override local council restrictions - meaning development is possible even where councils previously said no.

Applies unless local rules are more generous than state minimums.

Subdivision Opportunities

New subdivision rules allow 225m² minimum lots with 6m width in R1, R2 & R3 zones.

NSW Housing SEPP Dual Occupancy Revolution: New Opportunities for Property Owners

The NSW State Environmental Planning Policy (Housing) has undergone transformative amendments, with the most significant changes relating to dual occupancy development across residential zones. These reforms, implemented in two stages between July 2024 and February 2025, represent the most substantial planning changes in decades and have fundamentally altered dual occupancy development opportunities across NSW.

The Two-Stage Reform Timeline

Stage 1 (1 July 2024): Introduced blanket permissibility for dual occupancies and semi-detached dwellings in R2 Low Density Residential zones across NSW, with specific exclusions for sensitive areas and certain LGAs including Bathurst, Blue Mountains, Hawkesbury, and Wollondilly.

Stage 2 (28 February 2025): Implemented comprehensive non-discretionary development standards that override Local Environmental Plan (LEP) provisions, introducing standardized minimum lot sizes and development controls for dual occupancies across R1, R2, R3, and R4 zones in designated areas.

Revolutionary Dual Occupancy Standards

The February 2025 amendments introduced game-changing requirements for dual occupancy development:

Universal Minimum Standards: Dual occupancies are now permitted on lots in R1, R2, R3, and R4 zones with a minimum lot size of 450m² and minimum lot width of 12m, with a maximum FSR of 0.65:1 and maximum building height of 9.5m.

Override Power: These standards override existing LEP or DCP provisions unless the local provisions are more generous than the Housing SEPP standards. This means property owners can now develop dual occupancies even where local councils previously had more restrictive requirements.

Massive Impact on Property Eligibility

The scale of these changes is unprecedented. Research indicates these reforms extend dual occupancy eligibility to approximately 273,000 additional lots across Sydney metro alone, with 138,000 lots gaining eligibility due to the new minimum lot size rules and another 135,000 lots in R2 zones gaining permissibility.

Local Housing Areas: Properties within 800 metres walking distance of nominated train stations and town centres across Greater Sydney, Central Coast, Lower Hunter, Newcastle, and Illawarra-Shoalhaven regions receive the most significant benefits under the new policy framework.

Zone-Specific Opportunities

R1 General Residential: Now permits dual occupancies with the new 450m² minimum lot size, opening development opportunities previously restricted to single dwellings.

R2 Low Density Residential: All R2 zones across NSW (except excluded LGAs) now permit dual occupancies with development consent, regardless of previous local prohibitions. This represents the most significant change, affecting hundreds of thousands of properties.

R3 Medium Density Residential: Enhanced dual occupancy opportunities with standardized development controls, removing local council variations that previously created inconsistencies.

R4 High Density Residential: Streamlined dual occupancy approvals with consistent state-wide standards, reducing approval complexity and timeframes.

Complying Development Pathways

A critical aspect of these reforms relates to Complying Development Certificate (CDC) pathways:

Current Restrictions: Dual occupancies made permissible by the Housing SEPP in areas where they were previously prohibited cannot currently be carried out as complying development, but the government has indicated CDC pathways will be available from mid-2025.

Existing Permissions: In areas where dual occupancies were already permitted under local environmental plans, CDC pathways remain available immediately, with Housing SEPP minimum standards applying.

Subdivision Opportunities

The new framework also permits subdivision of lots in R1, R2, and R3 zones where proposed lots have a minimum of 225m² per lot and minimum lot width of 6m. This creates unprecedented opportunities for property owners to subdivide and develop, particularly in conjunction with dual occupancy development.

Excluded Areas and Constraints

Important exclusions apply to dual occupancy development under the new framework:

  • Heritage items and heritage conservation areas
  • Flood prone land based on Probable Maximum Flood (PMF) mapping
  • Coastal vulnerability areas
  • Areas within ANEF/ANEC contours of 20 or greater
  • Land within specified distances of certain pipelines
  • Bushfire prone land in certain LGAs

Council Minimum Lot Size Deadlines

Councils have until 1 July 2025 to establish minimum lot sizes for dual occupancy development in their local areas. Failure to do so will result in the NSW Government applying a default 400m² minimum lot size across the entire local government area. This deadline creates urgency for councils to engage with their communities and establish appropriate local standards.

Financial and Market Implications

These reforms create substantial financial opportunities:

  • Increased Land Values: Properties now eligible for dual occupancy development typically experience immediate value increases
  • Rental Income Potential: Dual occupancy development enables property owners to generate additional rental income streams
  • Reduced Development Costs: Standardized approval processes and non-discretionary standards reduce consultant fees and approval timeframes
  • Capital Growth Opportunities: Enhanced development potential creates long-term capital appreciation prospects

Practical Steps for Property Owners

To capitalize on these new opportunities, property owners should:

  • Conduct professional site analysis to determine current eligibility under new standards
  • Assess proximity to Local Housing Areas (800m from stations/centres) for enhanced opportunities
  • Review local council minimum lot size proposals before July 2025 deadline
  • Evaluate market conditions and rental yields in your specific area
  • Engage qualified consultants familiar with the new Housing SEPP framework
  • Consider subdivision opportunities in conjunction with dual occupancy development

Looking Ahead: Future Developments

The dual occupancy reforms are part of broader housing supply initiatives. Property owners should monitor:

  • Implementation of CDC pathways from mid-2025
  • Finalization of Local Housing Area mapping
  • Council adoption of local minimum lot size standards by July 2025
  • Potential further amendments to development standards

Expert Advice: The NSW dual occupancy reforms represent the most significant planning opportunity for property owners in decades. With at least 26,000 properties in Local Housing Areas alone gaining dual occupancy eligibility where it was previously impossible, professional assessment is essential to understand your property's new potential. At Adamus Associates, we specialize in navigating these complex new provisions and helping property owners maximize their development opportunities under the reformed Housing SEPP framework.
